3. Digital Products — Sales and Delivery
DataWhistl sells digital products, including but not limited to downloadable files, templates, guides, and data resources (“Digital Products”).
When you purchase a Digital Product from this website:
- You will receive access to or delivery of the Digital Product immediately upon confirmed payment, or as otherwise stated at the point of purchase.
- All Digital Products are delivered electronically. No physical goods will be dispatched.
- It is your responsibility to ensure that your device meets any compatibility requirements described on the product page before purchasing.
4. Pricing and Payment
All prices are displayed on the relevant product pages. Prices are stated in USD($) and include VAT where applicable.
We accept payment via the methods shown at checkout. Payment must be made in full before access to any Digital Product is granted.
We reserve the right to change prices at any time. Any change will not affect orders already placed and confirmed.
5. Cancellation Rights and Refund Policy
5.1 Your Right to Cancel (Cooling-Off Period)
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you ordinarily have the right to cancel a distance contract within 14 days without giving any reason.
However, you acknowledge and agree that, by completing your purchase and requesting immediate access to or delivery of a Digital Product, you expressly consent to the supply of digital content beginning immediately, and you acknowledge that you will lose your right to cancel once the download or access has commenced.
If you do not wish to waive your cancellation right, do not request immediate access to the Digital Product. In that case, you may cancel within 14 days, but access or download will not be provided until after that period has elapsed.
5.2 No Refunds for Change of Mind
Because our products are digital in nature and are delivered immediately upon purchase, we do not offer refunds or exchanges for change of mind once a Digital Product has been accessed, downloaded, or delivered.
5.3 Faulty or Misdescribed Digital Products
Notwithstanding the above, your statutory rights under the Consumer Rights Act 2015 are not affected. If a Digital Product you have purchased is:
- Faulty (i.e. it does not work as described or reasonably expected), or
- Not as described (i.e. it materially differs from the description given at the point of sale),
you are entitled to a remedy. We will first offer a repair or replacement. If that is not possible or does not resolve the issue, you may be entitled to a full or partial refund.
To raise a fault or misdescription claim, please contact us at hello@datawhistl.com within a reasonable time of purchase, with a description of the issue. We aim to respond within 5 working days.
5.4 Statutory Rights
Nothing in this policy affects your statutory rights under UK law. This includes your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
6. Intellectual Property
All Digital Products, website content, branding, and materials published on this site are the intellectual property of DataWhistl unless otherwise stated. You may not reproduce, redistribute, resell, or otherwise exploit any content or Digital Product without our prior written consent.
Upon purchase, you are granted a personal, non-transferable, non-exclusive licence to use the Digital Product for your own personal or internal business purposes only, unless a different licence is stated on the product page.
